Operators Who Have Allowed Ecological Damages are Obliged to Immediately Undertake Preventive Measures, Prescribes a Bill Discussed on Second Reading in Parliament

On its sitting on 9 April, 2008, National Assembly discussed on second reading a Bill regulating the liability for prevention and removal of ecological damages. The Bill foresees for operators, whose activity has resulted in a direct treat for ecological damages to undertake immediate preventive measures. In case when even though such measures were taken the condition persists, the operator is obliged to inform in written the competent authority – the Minister of Environment and Waters, the Directors of the Regional Inspectorates for Environment and Waters, the Management of Water Basins Directors and the National Parks Directors.
A fine between BGN 10 000 and 30 000 will be imposed as administrative penalty on facilities not launching immediate measures to remove the damages on the environment. When information has not been provided or the latter was false or misleading the sanction will be from BGN 2000 to 6000. In case when the operator has not supplied the requested by the competent authority information the penalty should be from BGN 1000 to 3000. For a repeated offence the sanction will go double.
MPs discussed on second reading the amendments in the National Center for Agrarian Sciences Act. It will be transformed into Academy of Agriculture. The amendments foresee to decrease in half the personnel of the Central Administration of the Academy. The Regional Centers for scientific and applied services will be transformed into state Enterprises.
Parliament discussed on second reading amendments in the Electronic Communications Act, the Roads Act, the Liability of the State and Municipalities for Damages. On first reading it approved amendments on the Extradition and European Order for Detention Act.
The 2004, 2005 and 2006 Annual Financial Reports of the National Health Care Insurance Fund, submitted by the Council of Ministers and passed through the Parliament’ s Finance and Budget Committee were put under debate as well as the Annual Report for 2007 of the National Personal Data Protection Commission.
