Amendments to Public Procurement Law Introduce Preliminary Control on Public Procurement Procedures of Projects Approved after January 1, 2009

The National Assembly adopted March 18, 2009 the amended Public Procurement Act. The changes regulate the oversight activities on public procurement procedures as follows: it stipulates the preparation of a report before the contract award and signing, which should contain information regarding the compliance of the presented documents and technical specifications with the law. Experts having managerial or other duties in the operational programs will become part of the commission executing the selection and assignments of public procurement contracts. The control over the “Transport” operational program is entrusted to the state Public Procurement Agency, for the rest the control is to be implemented either by the managing bodies of the very operational programs, or by other authorized by them units, which will also coordinate all the control activities.
